Video from our FREE Online Business Course www.myownbusiness.org Session 11 Buying a Business or Franchise Question “What was the worst mistake you made in starting your business?” Greg Gardea Owner of Garber’s BMW Topics covered in this video: Business mistakes, attorneys, leasing Transcript: I think that it’s extremely important whenever dealing with money that you always want to include a lawyer when making negotiations. I did not follow my own advice when I purchased this business and in doing so the previous owner’s attorney handled all the paperwork and so everything was set up very friendly to him. In looking back on it I think it would have been a great idea for me to have my attorney go over things and make sure things were a little more equitable. At the end of the day there really was no harm done. But the agreement has a lot of safeguards for him and none for me. So I think really it makes a lot of sense to just have somebody on your side look it over that has a knowledge of these things that has done these things before that doesn’t have an emotional stake in it so they can say “Look, hey you know I don’t think so. Look this is wrong” because they’ve done these things over and over, it’s their job. They can think it though. Where you might not be of that same position. You might just be so excited that this opportunity is there and you need to jump on it now because somebody else is going to get it then maybe it wasn’t the best deal after all.

Hi, I bought a beauty salon 3 and a half months ago in St. Albans, NY and the lady who sold it to me, lied about how much the salon makes a week and didn’t say that she was selling it because the neighborhood was bad and there are drugdealers selling drugs right next door of me and of course it scares the customers away. The thing is that I only gave her half of the money in the beginning and the other half I was supposed buy antibiotics online to pay it in 3 installments in 9 months (every 3 months), but the business doesn’t even make enough to cover the expenses and now I want my money back and don’t want the business. Does the law back me up on this? Do I have the right to ask her for my money back since there’s fraud? I would really appreciate an answer from a lawyer who knows about this.

Thank you!
